Motorcycle accidents can occur without notice. Most incidents involve head-to-head collisions with another vehicle, but others happen due to dooring. This action refers to a vehicle driver or passenger opening the door into the path of an oncoming motorcyclist.

A dooring accident can result in severe injuries that could prevent you from working. Understanding more about this can help in finding solutions to recover compensation.

Defining the dooring injuries

Opening a car door can be harmless, but it can be dangerous when an individual looks but fails to see you approaching. Common injuries of dooring accidents include, but are not limited to, the following:

Spinal cord injury

Traumatic brain injury

Internal bleeding

Severe burns

Road rash

Fractured bones

Organ damage

Aside from these severe injuries, your motorcycle can lose its operability, depending on its damage.

Proving your case

The person who opened the door has breached their duty of care, especially when there are signals or warning signs that inform drivers to move carefully. They failed to uphold the legal obligation to ensure their exit was safe and did not interfere with moving traffic. This negligence directly caused your injuries, establishing your right to file an injury claim.

Taking the next steps

Motorcycle accident claims can be a complex process in Indiana, especially since the state follows modified comparative negligence. If the court finds you are 51 percent or more at fault, the judge can bar you from recovering damages.

Gathering evidence of your accident, medical records and surveillance footage can help you demonstrate that you were following traffic rules. However, if you are unsure how to proceed, consulting a personal injury attorney can offer valuable insights into the matter.

Every motorcyclist knows the risks that come with sharing the road with larger vehicles. But when you are injured in an accident while lane splitting, those risks take on new dimensions in the legal arena.

Insurance companies and defense attorneys often seize upon lane splitting as a way to shift blame away from negligent drivers. This can jeopardize your right to full compensation.

Lane splitting in Indiana

Lane splitting refers to riding a motorcycle between lanes of stopped or slow-moving traffic. While this practice is legal in some states, Indiana law prohibits lane splitting. This legal distinction significantly impacts your accident claim.

If you were lane splitting when an accident happened, the other party's insurance company will likely use this fact to argue that you contributed to the collision. Even if another driver ultimately caused the accident, your involvement in lane splitting could reduce your ability to recover full damages.

Under Indiana's modified comparative fault rule, you lose the right to recover any damages if you contribute more than 50% to an accident. Conversely, if you hold 50% or less of the fault, your fault percentage reduces your potential damages. For example, if a jury assigns you 20% fault for lane splitting, and total damages equal $10,000, you would receive $8,000.

Proving fault and seeking compensation

To recover compensation, you will need to prove that the other driver was at fault and that you suffered damages as a result. Consider these steps:

Gathering all accident reports and police statements

Collecting photographs and videos from the accident scene

Obtaining contact information for any witnesses

Keeping detailed records of your medical treatments and expenses

Documenting any lost wages resulting from your injuries

Even if you were lane splitting, you might still have a valid claim for compensation. The other driver's distraction, speeding or other negligence could mean they bear some responsibility for the accident. Proving this requires a thorough investigation and a strong legal strategy.

Protecting your rights after a crash

The question is not whether lane splitting complicates your motorcycle accident claim, but whether you will let that complication prevent you from getting the compensation you deserve. Every day you wait to take action is another day insurance companies have to build their defense against your claim.

Take control of your situation by educating yourself about your rights and working with legal professionals who have a proven track record in motorcycle accident cases. Your recovery depends on it.

Motorcycle collisions have the potential to be far more devastating than crashes involving larger vehicles. After all, motorcycles offer very little protection from physical injury. Riders break bones, suffer spinal cord injuries and even develop brain injuries because of crashes with larger vehicles.

Injured motorcycle riders often seek to hold the drivers who cause crashes accountable by seeking compensation for their losses. They may face certain complications in their pursuit of financial justice. What common complications arise when motorcycle riders need financial compensation after a crash?

1. Insufficient insurance

Many drivers resent the obligation to pay for insurance. They only carry the minimum amount of liability coverage required by law.

Particularly in cases where riders sustain catastrophic injuries, they may find that the bodily injury coverage available is not enough to pay for their medical care. They also have to consider the cost of repairing or replacing their motorcycle and offsetting their lost wages. Instead of a simple insurance claim, motorcycle riders often have to look into options for litigation after crashes.

2. Bias from police officers and others

There are numerous negative social stereotypes about motorcycle riders. People often assume that every motorcycle rider breaks the law because they notice riders doing unsafe things in traffic occasionally.

Riders may find that police officers feel inclined to take another driver's word over theirs. They may also find themselves fighting an uphill battle against the internal biases of insurance professionals or those overseeing court proceedings. They may need help making their case sympathetic to others.

3. Challenges calculating future losses

When motorcycle riders sustain significant injuries, they likely have a stack of bills to cover. They also need to think carefully about future expenses.

Major injuries may trigger ongoing medical expenses for the rest of an individual's life or for several years after the collision. In some cases, people with injuries caused by motorcycle crashes may also experience a marked reduction in their long-term earning potential. They may be incapable of continuing their careers or may become unable to work at all.

Motorcycle riders hurt in crashes often need help evaluating their options and optimizing their compensation. Reviewing the circumstances surrounding a motorcycle collision can help riders in their pursuit of economic justice after a crash.

The Freedom of Information Act (FOIA) is a crucial transparency law. This federal statute allows journalists, lawyers and members of the general public to access various public records. Many states have enacted similar laws that reinforce or expand FOIA rules.

By submitting an information request, individuals can review court records, police reports and various other public records. The information that they gather could help them evaluate their rights if they get hurt in a car crash or because of criminal activity. FOIA requests sometimes take weeks to complete.

The process is slightly different in every jurisdiction. Concerned parties in Ohio, Indiana or Illinois may need help understanding how to initiate a public records request, and that’s okay. What is the proper procedure?

In Ohio

In Ohio, those requesting documents and public records without a statement of purpose. The Ohio Public Records Act even allows for the disclosure of certain records without a written request. Those seeking records can submit this form letter to the relevant government agency to request specific records.

In Indiana

In Indiana, state agencies must comply with the FOIA and the Indiana Access to Public Records Act. Some requests go directly through relevant agencies. Someone requesting a police report, for example, may file the request directly with the local police department. In cases where people need court records, the request goes through the Indiana Office of Judicial Administration. This form letter can help people secure the records they need.

In Illinois

In Illinois, members of the public can request copies of any public records, such as reports, writing, photographs, recordings and any other documentary materials maintained by public bodies. There are rules protecting certain confidential information, as well as business trade secrets. FOIA requests in Illinois should contain clear descriptions of the records sought and must go to the proper agency or organization. Those seeking police camera footage, for example, may file requests with the relevant police department. This process often begins with the submission of this form letter to the appropriate party.

Particularly in cases where people need records related to police activity or situations that caused injuries, timely action is of the utmost importance. Delays might put injured parties at risk of violating the statute of limitations for civil litigation. Those seeking public records as part of a personal injury lawsuit may need help with that process. The sooner injured people and grieving family members bring in professional support, the easier it may be for them to pursue justice.

Car crashes are a common concern. Many motorists eventually experience at least one collision, especially if they drive daily. People can also sustain injuries while riding as passengers in vehicles. Anyone involved in a motor vehicle collision may expect to receive compensation by filing an insurance claim.

Technically, the law does mandate that all motorists carry liability coverage. The party at fault for a crash provides coverage that can help pay for property damage losses and injuries sustained in the wreck. However, not every car crash results in people receiving adequate compensation through insurance alone.

Some people involved in collisions have to go to civil court in pursuit of financial compensation. Injured people may have the option of pursuing a personal injury lawsuit. Those who lose loved ones may have grounds for wrongful death lawsuits.

Not every driver follows the law

If every motorist consistently followed all traffic statutes, the number of crashes that occur would be substantially lower. It is quite common for drivers to routinely break certain laws regarding how they operate their vehicles. They may also violate the rules requiring insurance coverage. Some drivers make mistakes and forget to pay their monthly premiums. Others intentionally cancel their policies as a way of reducing their monthly expenses.

In both scenarios, uninsured drivers can leave others with few options after a crash. According to insurance industry claims data from 2022, an estimated 13.9% of drivers in Indiana lack proper insurance coverage.

There are also many people who do not carry sufficient insurance. Even those with policies that meet state standards may not have enough coverage to appropriately compensate those injured in a recent wreck. More significant injuries, including brain injuries and spinal cord injuries, can generate more in medical expenses than insurance covers. People may need to go to court, especially if they have to recover lost wages in addition to paying for their medical care or have lost a loved one.

Reviewing crash reports and insurance policy information with a skilled legal team can help people determine how to proceed after sustaining injuries in a motor vehicle collision. Civil litigation is sometimes the most effective way for people to obtain the support they require after a wreck.

Some car crashes are truly unavoidable. They might occur due to sudden infrastructure failure, such as sinkholes, or inclement weather that affects vehicles in a way that drivers cannot predict. The vast majority of collisions, however, are the result of choices made at the wheel or negligence on the part of individual motorists. Major car crashes are also a leading cause of death for people of all ages.

Many people unknowingly put themselves and others at risk of a tragic situation because they make questionable choices while driving. The three practices below have a strong association with increased crash risk.

Exceeding the speed limit

Speed limits exist for public safety. The idea is to restrict the rate of traffic based on the type of infrastructure nearby. Speed limits are lower in residential neighborhoods and sometimes nearly three times higher on interstates. Speeding makes it easier for drivers to lose control of their vehicles. It also increases how long it takes them to come to a complete stop. Excessive speed has a strong association with fatal crashes, including pedestrian crashes.

Driving while tired

Most people know they shouldn't drive after drinking or consuming prescription medication. It is illegal to do so, and there have been years of public awareness campaigns seeking to educate people about how dangerous such practices can be. Unfortunately, there is no law against fatigued or drowsy driving. Such statutes would be all but impossible to enforce. That being said, there is plenty of evidence that shows that those who have gone numerous hours without sleep can be as dangerous as those who are under the influence of alcohol.

Ignoring turn signals

Another common decision drivers make is to merge and turn without indicating their intentions. People can easily fall into the habit of not communicating with others in traffic. They could then cause completely preventable collisions. Those who don't use their turn signals are at risk of getting hit by others who don't know what they intend to do in traffic. They may end up blamed for the crash because the failure to indicate their intentions is what led to another driver proceeding through the intersection and hitting them.

Motorists who focus on safety can reduce their risk of causing a car crash. They can also identify when someone else is likely to blame for a wreck and seek compensation from the party responsible for a collision that occurs despite their own best efforts.

Some injuries are far more serious and debilitating than others. For example, a spinal cord injury could leave someone incapable of walking or living on their own without support. Brain injuries could leave people incapable of continuing their careers.

Compared with those catastrophic injuries, broken bones may not seem particularly serious. The average fracture responds well to medical treatment. People can expect to make a full recovery if they receive the right care.

Car crashes can very easily break bones in the human body. Occasionally, those broken bones might leave someone unable to continue working. The risk is particularly high for those in physical blue-collar professions. How could a fracture affect someone's ability to work and support themselves?

The fracture could be severe

The broken bones possible in a car crash are often far worse than the fractures people might experience if they get hurt by falling off of a step ladder. Fractures where the bones break into small pieces are possible. People may require surgery and may forever have pain or limitations on their functional abilities after breaking a bone in a car crash.

The fracture might heal poorly

Occasionally, a broken bone could potentially cause a more serious and even permanent medical challenge for the injured person. Broken bones are one of the physical traumas known to cause the onset of complex regional pain syndrome (CRPS).

CRPS sometimes begins with a minor to moderate physical trauma, like a fracture. The body responds improperly to the injury while healing, leading to permanent nerve damage as the fracture knits. Although the bone itself is no longer broken, the injured person may feel ongoing or even worsening pain in the affected body part. They may notice changes in the appearance of the injured body part and issues with their overall strength or flexibility. Particularly if employees perform blue-collar jobs, the lingering consequences of a severe fracture or CRPS could leave them unable to continue their current line of employment.

Someone coping with the aftermath of car crash injuries may need to file an insurance claim. If collision injuries cause long-term reductions in their earning potential, insurance may not be enough to cover someone's losses. Either way, recognizing that a broken bone could lead to lasting economic challenges can help people handle the aftermath of a recent car wreck. Holding a driver at fault accountable for the economic impact of injuries can help people rebuild their lives after an injurious, preventable wreck.

With the warmer months coming quickly, now is the time for motorcyclists and motorists to prepare for motorcycles on the roadways. If you are a motorcyclist, there are several things you can do to enhance your safety.

Because of a motorcycle’s open design, motorcyclists are more likely to suffer serious injuries or death in a crash than people in vehicles. Appropriate gear, including a helmet, can improve safety.

Inspect your motorcycle

After your motorcycle has been stored for the winter, it is essential to thoroughly inspect it. Check the tires for wear and ensure they're inflated to the correct pressure. Also, check the brakes, lights, chain and fluids.

Ride defensively

Adopting a defensive riding style can significantly reduce the risk of accidents. Assume that other motorists might not see you, especially at intersections, and be prepared to react. Keep a safe distance from vehicles ahead, and always have an escape route in mind should you need to avoid a sudden obstacle.

Watch for road hazards

Spring often brings with it a host of road hazards, including potholes, gravel and debris, which can be particularly dangerous for motorcyclists. Be vigilant and slow down in areas where the condition of the road is poor or unpredictable. Wet weather can also make roads slippery and reduce traction, so adjust your riding accordingly.

Practice good lane positioning

Good lane positioning helps make you more visible to other drivers and gives you the best view of the road ahead, as well as escape routes should you need them. Avoid riding in blind spots and change positions within your lane to increase your visibility to other drivers, especially at intersections where the risk of accidents is higher.

Communicate your intentions

Always signal your intentions well in advance whether you're changing lanes, turning, or stopping. Use your turn signals and consider using hand signals if you believe they will make your intentions clearer to other motorists.

Even motorcyclists who are driving safely can be struck by other motorists. If you’re one of those unfortunate victims, you should ensure that you get medical care right away. You may also opt to pursue compensation from the negligent motorist who struck you.

Car crashes are an inevitable side effect of motor vehicle travel. Collisions will occur when thousands of people travel through a municipality on any given day. Humans make mistakes, and vehicle components can sometimes fail. Occasionally, even the most safety-conscious driver can make a mistake that causes a crash. Although the majority of collisions are minor, some of them are more serious. People's vehicles may have such serious damage that they are no longer safe to drive. Crashes can also cause injuries to vehicle occupants that can range from minor to extreme.

Occasionally, those involved in a serious Indiana collision will file a lawsuit against the driver at fault for the crash. Why do people file personal injury lawsuits after a car wreck?

The driver at fault has no insurance

Technically, Indiana law requires liability insurance. Most insurance professionals also recommend that people invest in additional coverage, including uninsured motorists protection. Unfortunately, there will always be a small fraction of the population that refuses to comply with those rules. As of 2019, an estimated 15.8% of drivers were on the road without insurance in Indiana.

People never know if the individual who causes a wreck has proper coverage and could struggle to cover their expenses without it. Unless someone has uninsured driver coverage on their own policy, the only way to pay for crash expenses may be to file a lawsuit against the uninsured driver. Even if someone has uninsured motorist coverage, they would likely have higher insurance premiums in the future if they make a claim against their own policy.

The crash causes severe injury or death

Even if a driver has insurance, they may not have enough coverage to appropriately reimburse the other parties involved in a wreck. Crashes can cause catastrophic injuries that cost someone hundreds of thousands of dollars in medical expenses and lost wages. The coverage available through the policy of the at-fault driver may not be enough to fully reimburse those affected by the collision. Anytime a wreck produces expenses that insurance won't cover, those affected by the negligence or misconduct of others may need to contemplate a personal injury lawsuit.

Filing a lawsuit can compensate people for financial expenses and create consequences for a driver who caused serious injury to others. Seeking legal guidance when filing lawsuit becomes necessary is generally wise.

Anyone involved in a car accident on Indiana roadways might suffer injuries then require extensive medical care and rehabilitation. Accident victims who are injured as a result of a driver's negligence can often file a civil action to recover compensation to pay their bills. They could also seek compensation for pain and suffering and punitive damages. Many financial troubles could arise from lost wages and reduced earning capacity. Seeking compensation for those losses might be possible.

Claims for lost wages

Lost wages refer to the earnings lost after the accident. A credible claim for lost wages must prove that the injuries sustained from the accident led to losing out on income. The injuries must not be related to anything other than the accident to support a credible claim.

Presenting medical records and expert witness testimony might be necessary to prove such a claim. The plaintiff would also have to establish how much they lost in earnings by providing paystubs or other proof of income that preceded the accident.

Inability to earn a living

A reduced earning capacity may result from the accident, leaving the victim with a potentially uncertain financial future. Motor vehicle accidents that cause severe back, spinal or other catastrophic injuries may leave someone partially or fully disabled. A person who must perform many physical tasks on the job may need to find a lower-paying profession because their injuries force them to end their primary career. The victim may seek compensation to address their diminished earnings.

Filing a claim against a driver's liability insurance policy may be a viable alternative to a lawsuit as many drivers carry such insurance. Effective negotiations could lead to a substantial settlement, depending on how high the policy limits are.
